By accessing or using polysteplab's website, mobile application, or any of our Dutch language learning services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, then you may not access the Services.

These Terms constitute a legally binding agreement between you and polysteplab ("we," "us," or "our"). Your access and use of the Services is conditioned on your acceptance of and compliance with these Terms.

2. Description of Services

polysteplab provides interactive Dutch language learning services, including but not limited to:

• Online Dutch language courses and lessons
• One-on-one tutoring sessions
• Group classes and workshops
• Language assessment and proficiency testing
• Educational content and learning materials
• Progress tracking and analytics
• Mobile application access
• Community features and forums

3. User Accounts

3.1 Account Creation

To access certain features of our Services, you must create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for safeguarding the password and all activities that occur under your account. You agree to:

• Choose a strong, unique password
• Keep your login credentials confidential
• Notify us immediately of any unauthorized use of your account
• Log out of your account at the end of each session

3.3 Account Termination

We reserve the right to terminate or suspend your account if you violate these Terms or engage in any conduct we deem inappropriate or harmful to our Services or other users.

4. Payment and Billing

4.1 Fees and Charges

Certain aspects of our Services require payment of fees. All fees are clearly displayed before purchase and are charged in US Dollars unless otherwise specified.

4.2 Subscription Services

Some Services are offered on a subscription basis. Subscription fees are billed in advance on a monthly or annual basis and are non-refundable except as expressly provided in these Terms.

4.3 Payment Processing

Payments are processed by third-party payment processors. You agree to provide current, complete, and accurate payment information and to promptly update your payment method if it expires or is declined.

4.4 Refund Policy

We offer a 7-day money-back guarantee for new subscribers. Refund requests must be submitted within 7 days of initial purchase. Refunds are not available for:

• One-time purchases after services have been delivered
• Subscription renewals
• Accounts terminated for Terms violations

5. User Conduct

You agree to use our Services responsibly and in accordance with these Terms. You will not:

• Use the Services for any unlawful purpose or in violation of any applicable laws
• Share your account credentials with others
• Attempt to gain unauthorized access to our systems or other users' accounts
• Upload or transmit viruses, malware, or other harmful code
• Harass, abuse, or harm other users or instructors
• Use automated tools to access or interact with our Services
• Reverse engineer, decompile, or attempt to extract source code
• Share or distribute our proprietary content without permission

We grant you a limited, non-exclusive, non-transferable license to access and use our Services for your personal, non-commercial use in accordance with these Terms.

6.3 User Content

You retain ownership of any content you submit to our Services. However, by submitting content, you grant us a worldwide, royalty-free license to use, reproduce, and display such content in connection with providing our Services.

7. Privacy

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our Services, you consent to the collection and use of your information as outlined in our Privacy Policy.

8. Class Attendance and Cancellation

8.1 Attendance Requirements

Regular attendance is essential for effective language learning. Students are expected to attend scheduled classes and sessions punctually.

8.2 Cancellation Policy

For individual sessions:

• Cancel at least 24 hours in advance for a full credit
• Cancellations within 24 hours may result in session forfeiture
• No-shows will result in session forfeiture

For group classes, make-up sessions may be available based on availability.

8.3 Instructor Cancellations

If we cancel a session, you will receive a full credit or the option to reschedule at no additional cost.

9. Disclaimers and Limitations

9.1 Educational Results

While we strive to provide effective language learning services, we cannot guarantee specific learning outcomes or proficiency levels. Individual results may vary based on factors including effort, practice, and aptitude.

9.2 Service Availability

We aim to provide uninterrupted service but cannot guarantee 100% uptime. Our Services may be temporarily unavailable due to maintenance, updates, or technical issues.

9.3 Third-Party Content

Our Services may include links to third-party websites or content. We are not responsible for the accuracy, legality, or content of external sites.

10. Limitation of Liability

To the maximum extent permitted by law, polysteplab shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of our Services.

Our total liability to you for any claims arising from or relating to these Terms or your use of our Services shall not exceed the amount you have paid us in the twelve months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless polysteplab and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses arising from:

• Your violation of these Terms
• Your use of our Services
• Your violation of any rights of another party
• Your violation of any applicable laws or regulations

12. Termination

We may terminate or suspend your access to our Services immediately, without prior notice, if you breach these Terms. Upon termination, your right to use the Services will cease immediately.

You may terminate your account at any time by contacting our customer support team. Termination will not relieve you of any obligations to pay accrued fees.

13. Governing Law and Dispute Resolution

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

13.2 Dispute Resolution

Any disputes arising from these Terms or your use of our Services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

13.3 Class Action Waiver

You agree that any arbitration or legal proceeding shall be conducted on an individual basis and not as a class action or collective proceeding.
